BRENTWOOD-BENSON MUSIC PUBLISHING D/B/A GREATWORSHIPSONGS.COM PROVIDES THIS SITE AND RELATED SERVICES SUBJECT TO YOUR COMPLIANCE WITH THE TERMS AND CONDITIONS SET FORTH BELOW. This agreement (this "Agreement") is a legal agreement between you and BRENTWOOD-BENSON. You will signify your acceptance of this Agreement by using the Site (as defined below). If you do not agree to the terms set forth below, do not use the Site. BRENTWOOD-BENSON may modify, alter or otherwise
update these terms at any time. We will indicate any changes by updating the date at the top of this Agreement. We encourage you to review this Agreement from time to time. Your continued use of the Site following any changes to this Agreement will signify your assent to such changes.

PURPOSE OF THE SITE

This Site provides you with the opportunity to search the BRENTWOOD-BENSON music catalogue and purchase audio and/or printed music files.  YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, TRANSMIT OR DISTRIBUTE THESE FILES IN ANY WAY.  NOTWITHSTANDING THE FOREGOING, IF YOU ARE A CCLI LICENSE HOLDER, YOU MAY MAKE AND DISTRIBUTE COPIES OF THESE MUSIC FILES TO YOUR WORSHIP TEAM MEMBERS UNDER THE TERMS AND CONDITIONS OF YOUR CCLI LICENSE. In order to access the audio and/or printed music files, you will need to download an Mp3 compatible Media Player and the Adobe Acrobat Reader. BRENTWOOD-BENSON shall not be responsible for your downloading, inability to download, or use of the Media Player or Adobe Acrobat Reader.

MISCELLANEOUS

This Agreement is entered into in the State of New York, United States of America, and shall be governed by and construed in accordance with the laws of the State of New York, exclusive of its choice of law rules. Each party to this Agreement submits to the exclusive jurisdiction of the state and federal courts sitting in the Borough of Manhattan in the City of New York in the State of New York, and waives any jurisdictional, venue or inconvenient forum objections to such courts. In any action to enforce this Agreement, the prevailing party will be entitled to costs and attorneys' fees. In the event that any of the provisions of this Agreement are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

This Agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter hereof, and any and all written or oral agreements heretofore existing between the parties hereto with respect to the subject matter of this Agreement are expressly canceled. BRENTWOOD-BENSON may modify the terms of this Agreement by posting notice of such modification on a page of the Site entitled "Legal Notices" or "Legal Information" (or similar title) before the modification takes effect.

DESIGNATED AGENT UNDER THE DIGITAL MILLENNIUM COPYRIGHT ACT

The Digital Millennium Copyright Act ("DMCA") provides a mechanism for notifying service providers of claims of unauthorized use of copyrighted materials.
